Terms of Service

Version 1.4-pilot · Effective 2026-10-30

These Terms govern your organization's use of Arcanext during the closed pilot. They apply to the employer organizations and team members who are invited to use the service.

About these Terms

Arcanext is provided by Arcanext AI, 87, Tarabai Nagar, Saki Vihar Road, Powai, Mumbai, Maharashtra, India 400072 ("Arcanext", "we" or "us"). By acknowledging these Terms when you create, join or open a workspace, you accept them on behalf of your organization (the "Customer").

Each change to these Terms receives a new version number and effective date, and you are asked to acknowledge the new version before you continue using a workspace.

The closed pilot

Access is by invitation only, for the hiring teams of employers who sign in with a corporate email address. During the pilot the service covers:

  • Employer user accounts and organizations, through Clerk
  • Jobs, job descriptions and interview questionnaires, including drafts generated with Azure OpenAI
  • Candidate records and résumé files that employers upload, stored in private Azure Blob Storage
  • Résumé parsing, embeddings, matching and ranking against the employer's job, using Azure OpenAI
  • Billing in Razorpay test mode; no real payments are taken during the pilot

No candidate contact during the pilot

During the closed pilot, voice calling, candidate messaging and text interviews are switched off: Arcanext does not call, text or email candidates, and no candidate data is sent to Twilio, Deepgram or Cartesia or through Resend.

Your workspace and users

Each workspace belongs to one organization. You are responsible for the people you invite, the roles and permissions you give them, and for keeping their sign-in credentials secure. Sign-in and organization membership are provided by Clerk.

Candidate data you upload

Upload candidate data only where you are permitted to use it for your hiring purpose and have given candidates any notice the law requires. You are the controller of that data; Arcanext processes it on your behalf under the Data Processing Addendum.

Uploading a file or adding a candidate does not obtain a candidate's consent to be contacted, recorded or evaluated.

Confirmations when you start screening

Once voice screening or candidate messaging is switched on for your organization, starting screening for a batch of candidates asks you to confirm, by ticking a box, the statements that apply to that batch. We record who confirmed, when, and the text version. Each confirmation is your statement to us, and you are responsible for it being true. For every batch you confirm:

I confirm that as the Data Controller/Employer, we have provided required AI-processing notices to these candidates and hold lawful consent to contact them for this role.

Weekend and holiday calls

When a candidate's first call would fall on a Saturday, a Sunday or an Australian national public holiday in the candidate's local time, or when you call someone yourself on such a day, the call is placed only after you confirm:

I confirm we want to call these candidates on a weekend or public holiday in their local time.

Candidates who gave you their contact details

When a batch includes candidates who are not active applicants for the job and who would receive an invitation email, the invitations are sent only after you confirm:

These candidates provided their contact details to us for recruitment purposes.

This confirmation allows one invitation email per candidate per job. It is not consent to a call: a candidate is called only after they click to start the screen.

AI assistance and hiring decisions

Arcanext does not make hiring decisions. Résumé match scores and rankings are shown to the employer's hiring team, labelled for human review, and only a person at the employer can record a hiring decision.

You remain responsible for your hiring decisions and for meeting the laws that apply to them, including any notice, audit or record-keeping duties for automated tools where you hire.

Data Processing Addendum

The Data Processing Addendum published at arcanext.com/dpa forms part of these Terms and carries the same version number. If the two conflict on the processing of personal data, the Data Processing Addendum prevails.

Fees and billing

During the closed pilot, billing runs in Razorpay test mode and no real payments are taken. Any paid plan is agreed with you before a live charge is made.

Acceptable use

Do not use Arcanext to process data about people you are not permitted to process, to discriminate unlawfully, to upload malicious files, to probe, overload or disrupt the service, or to try to reach another organization's data.

Suspension and ending the pilot

We may suspend or end pilot access, for example for a breach of these Terms or when the pilot closes. You may stop using the service at any time.

Customer data is kept while the customer's organization account exists, including after a subscription ends or a plan changes.

How deletion works is described in the Data Processing Addendum.

Warranties and liability

The pilot is provided for evaluation, as is and as available. Each party's aggregate liability is capped at the total fees paid by the Customer in the 12 months preceding the claim.

Governing law

These Terms are governed by the laws of India, with exclusive jurisdiction of the courts of Mumbai, Maharashtra.
